PRIVACY NOTICE
Brother International Philippines Corporation (“Brother Philippines”) complies with Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012, its implementing rules and regulations, issuances of the National Privacy Commission, and other pertinent laws, rules, and issuances concerning data privacy (collectively, “Data Privacy Laws”). Brother Philippines only collects and uses your personal information in accordance with Data Privacy Laws.
This Privacy Notice describes the kinds of personal information that Brother Philippines collect and process, the basis for the processing of such personal information, and how your personal information is managed. It also gives details of how to contact Brother Philippines in case you want to execute any of your rights on your personal information held by Brother Philippines (i.e. right to access, objection, rectification, erasure or blocking, assignment, data portability), or you have inquiries or complaints about the management of your personal information.
Brother Philippines shall collect, both manually and electronically the following information from clients and customers: full name, address, email address, contact number, and the information on the product they purchased or that they would like to purchase (product name, model, and serial number) (collectively, “Personal Data”). The Personal Data are collected when customers fill out the warranty card or customer surveys on this website or through email, fax, postal mail or through Brother Philippines promotions or service centers. For Personal Data collected through the warranty card, the sales representative attending to customers will upload the data on the Retailwhiz. RetailWhiz is a Smart Retail Execution Application where collected personal data from warranty cards are stored.
The Personal Data collected is processed with your consent. In certain cases, Brother Philippines will process your Personal Data in order to perform its obligations or render services necessary for contract performance with the data subject, compliance with legal obligations, protection of vital interests, and legitimate business interests. Specifically, Brother Philippines will process your Personal Data based on the following:
- Contractual Performance: your Personal Data are necessary to create and maintain a membership with Brother Philippines and shall be processed by Brother Philippines for the processing and fulfillment of orders, billing and payments, for warranty tracking vis-à-vis purchased items, for the inventory of products, for providing services to you or for other reasonable purposes which are related thereto.
- Marketing Promotion: your email address or contact number may be used to send promotional materials, and updates about new products and services.
- Customer Support and Service: your Personal Data are used to analyze customer feedback and service usage data to improve overall customer experience, enhance service efficiency, and address any recurring issues.
- Business Analytics: Sales data, customer demographics and purchase history are processed and analyzed to identify trends and improve business strategies.
- Legal and Compliance: your Personal Data will be processed and may be retained to comply with legal requirements, such as those under taxation laws, and defend the company against potential legal claims.
Brother Philippines shall ensure that personal data under its custody are protected against unauthorized access, data loss, data breaches or any accidental or unlawful use, destruction, alteration, and disclosure as well as against any other unlawful processing. To mitigate these risks, Brother Philippines will implement strict access controls, encrypt data in transit and at rest, conduct regular security audits, and provide comprehensive employee training on data privacy and security. We also perform regular data backups and maintain robust disaster recovery plans, ensuring that personal data is not permanently lost. In case of a data breach, we have an incident response plan to promptly address and mitigate the impact. Additionally, we have protocols to ensure the accuracy and completeness of your data. Our company does not utilize automated access to personal data, ensuring that all data handling is performed with human oversight.
Brother Philippines is implementing appropriate security measures in storing collected personal information, depending on the nature of the information. For paper-based documents, active personal data will be stored in locked filing cabinet and for digital/electronic files, it is stored in password-protected computers.
Brother Philippines shall store your personal data until you order their removal from our system but shall no longer than necessary or required by Data Privacy Laws. You may submit your request through the following alternatives:
Email Request: You can send an email to our Data Protection Officer at dpo@brother.com.ph with the subject line "Data Deletion Request." Please include your account details and specify the data you wish to be deleted.
Customer Support Hotline: Call our dedicated customer support hotline at +63 (2) 8581 9898 and speak to a customer support representative to request data removal. Please have your account details ready for verification.
Mail-In Requests: Send a written request to Brother International Philippines Corporation, 6F Marajo Tower, #312 26th St. West corner 4th Ave., Bonifacio Global City, Taguig City, Attention: Data Protection Officer. Include your account details and specify the data you wish to be deleted.
In-Person Requests: Visit our office at Brother International Philippines Corporation, 6F Marajo Tower, #312 26th St. West corner 4th Ave., Bonifacio Global City, Taguig City and request data removal in person. Please bring valid identification to verify your identity.
Brother Philippines may be required to store the data longer to fulfill post-contractual obligations, to comply with statutory obligations, or to respond to legal process pursuing legal rights and remedies, defending litigation, and managing any complaints or claims. If retained, Brother Philippines will transfer data to an archive storage and will not be used for any purpose other than indicated. All information gathered shall not be retained for a period longer than ten 10 years.
After ten (10) years, all hard and soft copies of personal information under the custody of Brother Philippines shall be deleted, disposed, and destroyed through secured means, from its server and back-up by responsible officers of Brother Philippines; shredding of paper documents; and anonymization of data to the extent that the personal data can no longer be retrieved, processed, and accessed by any person.
Due to the sensitive and confidential nature of the personal data under the custody of Brother Philippines, only the client and the authorized representative of Brother Philippines shall be allowed to access such personal data, for legitimate business purpose and only to the extent necessary to achieve said purpose. The details of the products and services which you purchase from Brother Philippines or which you have inquired about, such as model, serial number, and dealer name, will be disclosed to Brother group companies for the purpose of improving our products and customizing your experience in our website.
All employees, agents and representatives of Brother Philippines shall maintain the confidentiality and secrecy of all personal data that come to their knowledge and possession, even after resignation, termination of contract, or other contractual relations. Personal data under the custody of Brother Philippines shall be disclosed only pursuant to a lawful purpose, and to authorized recipients of such data.
Please be advised that as a Data Subject defined under Data Privacy Laws, you have the following rights:
- Right to be informed. You have the right to be informed whether your personal data is being, or have been processed by Brother Philippines, including the existence of automated decision-making and profiling.
- Right to object. You have the right to object to the processing of your personal data, including processing for direct marketing, automated processing, or profiling.
- Right to Access. You have the right to reasonable access, upon written request, the contents of your personal data that were processed by Brother Philippines; the manner by which these were processed; the sources from which these were obtained; the recipients and reasons for disclosure, if any; date when your information was last modified; and if any, information on automated processes where your information will be made as the sole basis for any decision that may significantly affect you.
- Right to rectification. You have the right to dispute the inaccuracy or error in the personal data and have Brother Philippines correct it immediately and accordingly, unless the request is vexatious or otherwise unreasonable.
- Right to erasure or blocking. You have the right to suspend, withdraw or order the blocking, removal, or destruction of your personal data from Brother Philippines’ filing system based on reasonable grounds. However, Brother Philippines may retain certain personal data even after you have requested the deletion to comply with its statutory obligations.
- Right to data portability. For your personal data processed by electronic means and in a structured and commonly used format, you have the right to obtain from Brother Philippines a copy of such data in an electronic or structured format that is commonly used and allows your further use.
- Right to damages. You shall be indemnified for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of personal data.
- Right to file a complaint. You may file a complaint or exercise your rights above by reaching out to us through the contact details provided below. You may also raise privacy concerns to the National Privacy Commission through their website at www.privacy.gov.ph.
- Right to withdraw your consent. If Brother Philippines processes your personal data based on your consent, you may withdraw your consent at any time. However, withdrawing your consent will not affect the lawfulness of the processing prior to the withdrawal.
